Service Pack 3 ("Service Pack") contains updates to:
Microsoft SQL Server 7.0 and Microsoft Data Engine (MSDE) 1.0
IMPORTANT: READ CAREFULLY - The Microsoft Corporation ("Microsoft") software product updates listed above, including any electronic documentation ("Updates"), are subject to both the terms and conditions of the agreement (an "End User License Agreement" or "EULA") under which you (an individual or an entity) have licensed a Microsoft software product identified below (each, a "SOFTWARE PRODUCT") and the terms and conditions of this Service Pack End User License Agreement ("Service Pack EULA"). Capitalized terms used and not otherwise defined herein shall have the meanings assigned to them in the EULA.
BY INSTALLING, COPYING OR OTHERWISE USING THE UPDATES OR ANY PART THEREOF, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THE APPLICABLE EULA AND THIS SERVICE PACK EULA. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT INSTALL, COPY OR USE THE UPDATES. You are not authorized to use the contents of this Service Pack if you do not have a valid license for one of the following SOFTWARE PRODUCTS:
1. Microsoft SQL Server 7.0; Microsoft SQL Server 7.0, Enterprise Edition, Microsoft BackOffice Server 4.5 (or any other Microsoft product that includes Microsoft SQL Server 7.0, or Microsoft SQL Server 7.0, Enterprise Edition; or
2. Any Microsoft or third party product which contains the technology feature known as Microsoft Data Engine (MSDE).
GENERAL LICENSE TERMS:
1. The Updates supplement or replace certain existing functionality of the SOFTWARE PRODUCTS. Microsoft grants you a license to use the Updates, or any portion thereof, on your computers or within your organization that include a validly licensed copy of a SOFTWARE PRODUCT, subject to your compliance with the terms and conditions of the EULA (incorporated by this reference) and this Service Pack EULA. To the extent any terms in this Service Pack EULA conflict with terms in the EULA, the terms of this Service Pack EULA control solely with respect to the Updates.
2. This Service Pack is provided "AS IS" with all faults and without warranty of any kind. The entire risk as to the results, performance or non-performance, or support of your use or redistribution of this Service Pack remains with you.
ADDITIONAL LICENSE LIMITATION:
Clustering and three (3) gigabyte memory support are features of Microsoft SQL Server 7.0, Enterprise Edition only. You are licensed to install and use the Updates applicable to such features only if you have a valid license for Microsoft SQL Server 7.0, Enterprise Edition.
REDISTRIBUTION LICENSE RIGHTS:
You agree to use commercially reasonable efforts to verify, from time to time, that you are distributing the most recent version of the Service Pack (for example, this is Service Pack 3, which may be replaced by Service Pack 4). The latest version will be found at the Microsoft web site currently located at http://support.microsoft.com/support/sql, and if you find a more recent version, you may download the files for your own use only. You may not redistribute any such files without first obtaining them on a CD-ROM from Microsoft.
Subject to the foregoing, Microsoft grants you a non-exclusive, worldwide, royalty-free license to reproduce, distribute and sublicense to end users an unlimited number of copies of this Service Pack, in its entirety and on CD-ROM media, solely for use in conjunction with your computer hardware or software product that is designed to operate in conjunction with any of the SOFTWARE PRODUCTS listed above, subject to the following additional terms and conditions.
1. Each copy made by or on your behalf shall be a true and complete copy, including all copyright and trademark notices contained in this Service Pack.
2. The Service Pack is provided in multiple foreign language versions and multiple platform (e.g., Intel and Alpha) versions. For your chosen foreign language and/or platform, you shall distribute all of the Service Pack files as delivered by Microsoft.
3. You shall distribute your software product with the Service Pack incorporated therein, on one or more CD-ROMs, and pursuant to an end user license agreement for use of the Service Pack with terms no less protective than those contained in the EULA and this Service Pack EULA. Your end user license agreement may be "break-the-seal", "click wrap" or signed. You may not distribute the Service Pack as a web download or by any other means with out Microsoft's prior written consent.
4. You shall not distribute this Service Pack or any portion thereof for profit or as a standalone product.
5. You shall not modify this Service Pack or any portion thereof.
6. You shall not license or otherwise permit further redistribution of this Service Pack or any portion thereof.
7. All product support related to your distribution of this Service Pack and your software application is and shall remain your sole responsibility.
